A. INTRODUCTION

By using any of our Positively DKC services, you are agreeing to comply with the below Terms and Conditions.

These Terms tell you about us and the legal terms and conditions on which you are allowed to giveback, consign, sell, swap products. The Terms and Conditions are the agreement between DKC and the customer/seller.  

The terms "us", "our" "we" or "DKC" refer to Designer Kids Club Ltd. The term "you" " Seller" and "Customer" refer to the consumer on our Site. 

Please read these Terms carefully and make sure that you understand them, before selecting a service. Please note that by listing any products you agree to be bound by these Terms and Conditions. 

We amend these Terms from time to time. Every time you wish to list products, please check these Terms to ensure you understand the terms which will apply at that time. 

 

B. ABOUT DKC

We are DKC and we operate the website and marketplace www.designerkidsclub.com. We Designer Kids Club Ltd, a company registered in the United Kingdom under company number 15507491. Our registered office and main trading address is Apt 212 Metropolitan Apartments, 20 Lee Street, Leicester, LE1 3RF.

C. GLOSSARY

  • "Seller" means everyone who uses a Positively DKC service, this includes giveback, consign, sell, swap,  donate or VIP Me to send products to us, that we list on our site with the intention of selling them;

  • "Account" means a customer account which has been opened by you through our website;

  • "Order" means an order for a Product placed on the website;

  • "VAT" means Value Added Tax;

  • a person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality);

  • a reference to writing or written includes emails or any other written for of contact.

D. REGISTRATION PROCESS

Please note that currently the Positively DKC is available for UK Customers only. You will be asked to register on the website by providing your email address and creating a password. You must use all reasonable steps to keep your password confidential, and must inform us if you suspect or discover that your password has become known to someone else. You shall use your account to sell us Products in accordance with the process outlined on our website.

All customers are pre-approved and authorised by DKC. Customers can either send items to our business premises or we can arrange collection depending on the service you choose.

Accepted items include designer baby, boys and girls wear from newborn to 14 years, in addition to shoes and accessories. As a guideline, a typical item would have had a minimum retail price of at least £40 or higher. Pre-worn (also known as pre-loved) items must be in good condition. Unworn, or past season items must include their original tags if available.

E. QUALITY, ASSURANCE, AUTHENTICITY CHECKS & POSTAGE COSTS

 

INSPECTION PROCESS

All items received by DKC are put through our 8 step inspection process. We check to ensure alignment, suitability, quality, condition and authenticity. Rejected items will be sent to our charity partners, unless otherwise requested and returned to the customer. 

At DKC we say a big NO to fakes or replicas. Our luxury items are authenticated which protects businesses, buyers and sellers from inadvertently transacting in counterfeit and fraudulent items. Read more here.  In addition, our in-house team of experienced authenticators makes sure the items are genuine and if it doesn't satisfy our Quality Control Team, we will simply don’t buy or sell them. Rejected un-authentic items will be sent to our charity partners, unless otherwise requested and returned to the customer, at your own expense. We will request full costs for the authentication,  postage and packaging before we return them to you.

CURATION & STORAGE

All pre-worn items are sent for cleaning (unless they have already been cleaned properly, and or include the cleaning tags). DKC has negotiated discounted business rates. Dry cleaning costs are £9.95 for garments and £15.00 for outerwear. Some items may cost more to clean and if this is the case, DKC will inform the seller in advance for authorisation. Cleaning costs are deducted from the seller’s final payment.

All items are professionally photographed and listed on the DKC website. They are individually listed with style descriptions and categorised by various features. Sellers send items at their own risk and DKC is not liable for any damages, loss or theft for items in transit. Once the items are received and in our control they are our responsibility, this includes whilst in storage or off-site at pop-ups, tradeshows etc. 

POSTAGE COSTS

Giveback: We pay for all the postage costs to us, you will be responsible for all postage costs back to yourselves. i.e. if your items are rejected or not as you described. If we have to revise our original/provisional offer due to discrepancies in your description or as a result of our inspection process and you refuse the revised/final offer you will need to also pay the postage costs for your items to be returned to you. We deduct the postage cost once the item has been sold. 

Consign/Sell with us: We pay for all the postage costs to us, you will be responsible for all postage costs back to yourselves. i.e. if your items are rejected or not as you described. If we have to revise our original/provisional offer due to discrepancies in your description or as a result of our inspection process and you refuse the revised/final offer you will need to also pay the postage costs for your items to be returned to you. We deduct the postage cost once the item has been sold. 

VIP selling: We are responsible for all the postage costs. However If we have to revise our original/provisional valuation due to discrepancies in your description or as a result of our inspection process and you refuse the revised offer you will need to pay the postage costs for your items to be returned to you.

Donate: We are responsible for all the postage costs.

Swap: You are responsible for all the postage costs to send the items in to us, we are responsible for all the postage costs back to you. 

F. SELLING PROCESS & PRICING

DKC has full discretion on the sale price for each item, we determine the selling price, which is competitive and fair for customer’s that buy and sell. The sell price is typically between 40- 50% off the original retail price and discounts can go up to 80%, depending on the quality of the garment.. For new or excellent condition items or exclusive pieces we can expect to sell for 60-70% of the original retail price. DKC reserves the right to reduce item sale prices after a reasonable period of time if they have not sold and can continue to reduce prices until such time that they are eventually sold.

We will minus any cleaning and authentication costs from any payout (if applicable).

 

G. UPON SALE OF ITEMS

For the Consign or VIP  options;

  • Only if the Seller's item passes our quality and authenticity check we will immediately dispatch it to the Buyer.

  • If the Seller's item does not pass our authenticity check the Seller will be liable to pay an authentication fee and cleaning costs, as well as postage and packing costs for the item to returned back to you.

  • If the Seller's item will not match the images and the description of the item it will be returned to the Seller at their cost.

  • We will only deduct payment once the Buyer submits their payment details on the website and purchases the Product (your item)

  • Once payment can be processed, we will deduct the applicable commission.

  • You will receive an automatic notification email once your Product is sold

  • Only after the item is sold will we contact you to obtain either you bank details or PayPal details for payment. In the event that we are unable to obtain payment details we will hold your funds until we have obtained payment details. Please note that we will not cover any fees that may result from bank/ PayPal charges or currency conversion.

  • The Buyer will have 24 hours to raise any issues. Please note that we do not accept any returns on the items purchased on our website from the Sellers.

PROMOTIONS

Items are promoted on DKC from time to time and any additional discounts (such as discount codes) are deducted from DKC sale proceeds, rather than the seller’s.

CHARITY

DKC donates 5% of its profits from sales to charities we support. Seller’s have the option to match this donation share or donate their entire share. 

H. CONTENT SUBMITTED BY USERS

You are responsible for any User Content posted to the site. “User Content” means any content you post to the site, which may include reviews, questions, image uploading, and other such features that allow Users to add content to the site. We reserve the right to remove any User Content generated by any user at our sole discretion if we decide that the content is not authentic or harmful. By posting to the Site, you understand that once you post User Content, your content becomes public. We are not responsible for keeping any User Content confidential so if you do not want anyone to read or see that content, do not submit or post it to the Site.

If we allow you to upload User Content, you may not: 

  • Provide User Content that you do not have the right to submit, unless you have the owner’s permission; this includes images and any other material covered by someone else’s copyright, patent, trade secret, privacy, publicity, or any other proprietary right; 

  • Provide any User Content that contains lies, falsehoods or misrepresentations that could damage us or anyone else; 

  • Provide User Content that is illegal, obscene, defamatory, libellous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourage conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; 

  • Impersonate anyone else or lie about your affiliation with another person or entity in your User Content; 

 

I. RESTRICTIONS 

You must be at least 18 years old and legally capable of entering into binding contracts in order to sell any Product(s).

You must be a UK seller.

J.ACCEPTANCE

Sending items to DKC will be deemed as acceptance of the seller’s terms and conditions as listed above.

  • What about fakes?

  • How do you determine the sale price?
    We base our sale price on historic data, season, condition, RRP, demand and many other variables. You can see what we tend to sell items for on our website to give you a very good indication. We will soon implement an AI tool to give you a sale price estimation before listing on our platform.
  • Where will you sell my items?
    In a bid to sell your items, they will be stocked our warehouses ready to be sold online via our own website and on partner platforms. During busy periods, items can take up to 2 weeks or longer to appear online. We drop products at the most optimal time based on seasonality or special category or brand drops to give them the best chance of selling. We also host pop us shops at retail events such as the John Lewis Baby Event, and national exhibitions.
  • What can I send in?
    Only luxury childrens designer wear & baby clothes 0-14 Years old. Items that are current season & trend driven as well as investment pieces sell the best and fastest with us.   • What's your commision?
    Each time an item sells, credits will be added to the your DKC account based on a percentage payout. We offer -100% of the sale price in DKC store credit, it never expires - Or 75% of the sale price in cash transferred to your bank You can also choose to donate your portion to charity rather than getting it as DKC credit if you would prefer.
  • How will I receive my payout?
    After an item's 14 day return window has passed, a sale is confirmed to you and you will asked whether you will like to take the 100% DKC credit option or 75% Cash Payout. We will ask for payment details i.e. Bank details
  • What do I need to do?
    Nothing really. Let us do all the heavy lifting, from collecting your items, cleaning, authenticating, photographing, pricing, marketing and reselling. No need to lift a finger, we have it all under control. Sit back and watch as we make the magic happen.
  • Are there any other costs I should know about?

  • What about postage costs?
    We initially cover all postage costs, once you request a DKC box we will send you a prepaid box in the post. Once you have filled the box you will need to request a returns postage label (electronic) using the following link http://www.royalmail.com/track-my-return/create/8028 Once packed take it to your nearest drop off point. They will scan the QR code and print the labels. We deduct the postage costs once the item has been sold.   • Can I track the progress of my DKC box?
    Once you have arranged the return of your box you will be able to track its progress via the provider. You will also receive an email from us notifying you when your box has been received.
  • What charities do you work with?
    We donate to sustainable charities that focus on creating lasting solutions rather than providing temporary fixes. This is because they aim to address the root causes of issues, ensuring that communities can continue to thrive independently in the future. This aligns with our mission and corporate values.   • What are the consignment criteria?
    ✅ ONLY AVAILABLE IN THE UK, ITEMS MUST BE WORTH OVER £100 (Our sell price not RRP) ​ ✅ We only accept children's and baby clothing (0-14YEARS) , shoes and accessories from luxury brands such as Burberry, Versace, Fendi, Moncler, Gucci etc ​ ✅ Item's must be in good condition, only send clean and freshly laundered items ​​ ​ ❌ Items with heavy wear and tear, or heavily worn ​ ❌ Notable damage, such as missing parts, rips, stains and odors ​ ❌ No alterations, including missing sizing information ​ ❌ Banned items (including furs)
  • What do I do after I have ordered and packed my free DKC box?

  • How long you keep items and what if they don't sell?
    Generally we keep items for 6 months on a sale or return basis. The onus is on you to contact us to collect them at the end of the term. We reserve the right to reduce item sale prices after a reasonable period of time if they have not sold and can continue to reduce prices until such time that they are eventually sold. Items are eligible for up to 25% discount after 2 months and 50% discount after 4 months. If it doesn't sell within this 6 month sale period, it may be reduced further or you can either choose to collect the item or pay to have it returned. Or we have many wonderful charities with whom we work to which we can donate it on your behalf.
  • What quality checks do you do?
    We are particularly passionate about luxury children wear, quality, care and authenticity. We value our global community of circular fashion lovers visiting our online store every day and therefore quality control is essential and central to every single stage of our work. You can rest assured with our 8 Step Quality & Assurance Process. This ensures that only the highest quality collections are stocked. ​ STEP 1: APPROVAL: Approved to sell by our experienced designer children wear fashion stylist. STEP 2: INSPECTION: Fully inspected and authenticated via a leading authentication service. STEP 3: CLEANED: All pre-loved items are professionally cleaned and curated ready for sale. STEP 4: GRADING: Checked for signs of wear & tear and graded using a industry recognised grading standard 1-4. STEP 5: PHOTOGRAPHED: Professionally photographed, presented and listed on the website. STEP 6: TAGGING: Final checks ensuring items are properly described, sized, tagged and stored ready for sale. STEP 7: SEAL OF APPROVAL: Upon sale they are inspected once again, given an our DKC seal of approval, wrapped and packaged for delivery.
